What's included in the trust setup fee?

The setup fee covers everything needed to establish your trust: custom deed drafting, settlor/trustee/beneficiary documentation, initial asset transfer paperwork, IRD registration, and your first year's trust minutes. There are no hidden costs beyond what we quote upfront.

Are there any hidden costs?

No. We provide transparent, upfront pricing. The only additional costs would be for optional services you choose (such as property transfers requiring Land Information NZ registration, or complex asset restructuring), which we'll discuss and get your approval for before proceeding.

Can I pay in instalments?

Yes, we offer flexible payment plans for trust setup fees over $2,000. Most clients spread payments across 3-6 months. Contact us to discuss options that work with your budget.

Do I need ongoing administration?

Yes. The Trusts Act 2019 requires proper record-keeping, annual trustee meetings, and documentation of all decisions. Our annual administration ensures you meet all legal obligations and maintain the asset protection benefits of your trust. Without proper administration, your trust could lose its legal protections.

What happens if I don't maintain my trust properly?

Poor trust administration can result in: loss of asset protection, IRD penalties for non-compliance, beneficiary disputes due to lack of documentation, and potential challenges to trust validity. Regular professional administration prevents these issues and ensures your trust operates as intended.

How much does it cost to update an old trust to comply with the Trusts Act 2019?

Trust review and modernization typically costs $1,500-$3,000 depending on the complexity of your existing deed and what changes are needed. This includes a full compliance review, recommended amendments, and updating trustee documentation. All trusts established before 2021 should be reviewed.

Is the cost tax-deductible?

Generally, trust setup costs are not tax-deductible for personal family trusts. However, ongoing administration costs may be deductible if the trust holds business assets or rental properties. Consult with your accountant for specific advice on your situation.

What's the difference between Basic and Full Service administration?

Basic Administration ($800/year) covers the minimum legal requirements: annual minutes, resolutions, and IRD support. Full Service ($1,500+/year) includes everything in Basic plus gifting program management, financial statements, asset register updates, and ongoing trustee advisory support. Full Service is recommended for trusts with multiple properties or complex asset structures.
